نامه اعتراض جمعی به حضور محمدجعفر محلاتی در دانشگاه ابرلین آمریکا

رئیس محترم کالج ابرلین، خانم دکتر امبر

ما امضا کنندگان این نامه گروهی از زندانیان سیاسی سابق در ایران، خانواده زندانیان سیاسی اعدام شده، فعالین حقوق بشر که برای عدالت و پاسخگویی مسئولین فعالیت میکنند، و حقوقدانانی که به پرونده نقض فاحش حقوق بشر توسط رژیم ایران رسیدگی کرده اند، و شهروندان نگران هستیم

امضا کنندگان این نامه به حضورتان می رساند که اخیرا متوجه شده ایم که آقای محمد جعفر محلاتی مسئول مطالعات خاورمیانه و شمال آفریقا در کالج ابرلین شده است. این انتصاب ما را بسیار شگفت زده کرده است چرا که ما بر اساس اطلاعات ارائه شده در زیر معتقدیم که انتصاب وی برای این نقش با ارزشهای دانشگاه ابرلین مغایرت اساسی دارد.

جنابعالی حتما آگاه هستید که آقای محلاتی بین سالهای ۱۳۶۷ - ۱۳۶۸ سفیر و نماینده دائمی ایران در سازمان ملل بوده است. در طول زمان نمایندگی‌ ایشان در سازمان ملل ، ما معتقدیم شواهد آمده در زیر نشان می دهد كه نقش وی مبهم گوئی، انکار، و دروغ گفتن به جامعه جهانی در مورد جنایات جمعی مرتكب شده توسط رژیم ایران بوده است.

گرچه ۴۰ سال حاکمیت جمهوری اسلامی بر ایران همواره با نقض فاحش حقوق بشر همراه بوده ولی کشتار زندانیان سیاسی در تابستان ۱۳۶۷ که جملگی دوران محکومیت شان را سپری می کردند، اوج ظلم و جنایت این رژیم است. در طول سه ماه تابستان ۱۳۶۷ رژیم جمهوری اسلامی ایران تمامی زندانیان سیاسی سراسر کشور را بر پایه فتوای خمینی برای محاکمه مجدد به دادگاه های چند دقیقه ای کشاند. دادگاه هایی که عاری از هرگونه تشریفات قانونی مبتنی بر استاندارد های شناخته شده بین المللی بود. این دادگاه ها به ریاست کسانی بود که به "کمیته مرگ" شناخته شده اند. در این به اصطلاح دادگاه ها، زندانیان سیاسی ای که سالها بود دوران محکومیت شان را بر مبنای احکام دادگاه های خود رژیم جمهوری اسلامی ( که بر اساس قوانین حقوق بین الملل ناعادلانه و فاقد هرگونه وجهه قانونی بودند) توام با شکنجه های وحشیانه سپری می کردند، با چند سوالی روبرو میشدند که اعضای کمیته مرگ از آنها درباره نظرات سیاسی و یا عقاید مذهبی شان می پرسیدند. بر مبنای پاسخ زندانیان به این چند سوال، به فرمان کمیته مرگ به دار آویخته میشدند. بنا بر گفته های آیت الله منتظری- نفر دوم در رده رهبری رژیم- بیش از ۳۸۰۰ زندانی سیاسی در طول تابستان ۱۳۶۷ توسط کمیته های مرگ بقتل رسیدند. گرچه بسیاری از منابع دیگر، تعداد زندانیان اعدامی در این دوران را خیلی بالاتر از ۳۸۰۰ نفرتخمین میزنند.

هم اینک، کشتار دسته جمعی زندانیان سیاسی در تابستان ۱۳۶۷ به خوبی مستند شده. سازمان عفو بین الملل آن را " اقدامی جنایتکارانه علیه بشریت که جنایتی ادامه دار است" نام نهاده و سازمان دیده بان حقوق بشر موافقت خود را با این ارزیابی اعلام داشته است. در سال ۲۰۱۲، گروهی داوطلب با سرمشق قرار دادن مدل معروف به دادگاه راسل (که در سالهای ۱۹۶۰ میلادی برگزار شده است) دادگاهی بنام "دادگاه ایران تریبونال" به ریاست برخی حقوقدانان شناخته شده بین المللی در حوزه حقوق بشر، بنا نهادند. وظیفه این دادگاه جمع آوری و ثبت مدارکی دال بر سنگدلی و قساوت محض رژیم جمهوری اسلامی علیه مخالفانش در دهه شصت بود. رای این دادگاه که مورد موافقت تمامی حقوقدانان قرار گرفت، همانا یکی دانستن جنایات جمهوری اسلامی با تعریف پذیرفته شده در مورد "جنایت علیه بشریت" بود که توسط دادگاه رسیدگی به جنایات بین المللی قوانین رم صادر و ثبت شده است. همچنین پارلمان کانادا در سال ۲۰۱۶ میلادی قتل عام های انجام شده توسط جمهوری اسلامی را همانا جنایت علیه بشریت دانسته و آن را برسمیت شناخت. 

بنابر گزارش مفصل سازمان عفو بین الملل، این سازمان از مرداد تا دی ماه سال ۱۳۶۷ حداقل شانزده اعلامیه صادر کرده و از فعالین‌اش خواسته که با اقدامی فوری به مقامات جمهوری اسلامی ایران نامه ارسال کرده و خواستار آن شوند که به کشتار غیرقانونی زندانیان سیاسی فورا پایان دهند.

اولین مورد از اقدامات فوری سازمان عفو بین الملل در۲۵ مرداد سال ۱۳۶۷، پس از اعدام گسترده طرفداران و مبارزین سازمان مجاهدین خلق ایران صادر شد. و این درست ۱۱ روز قبل از قتل عام هزاران زندانی سیاسی وابسته به سازمان‌های چپ بود. در آن زمان، هزاران تلگرام، تلکس، و نامه از جانب فعالین سازمان عفو بین الملل به رئیس دادگاه عالی‌ قضایی، وزیر دادگستری، و نمایندگان سیاسی و دیپلمات‌های رژیم جمهوری اسلامی در کشور‌هایشان فرستاد شد. سازمان عفو بین الملل و اعضایش با محکوم کردن این قتل عام ها، خواهان خاتمه اعدام‌ها در ایران شدند. در نتیجه با استناد به این اسناد ، ما اعتقاد داریم که باور کردن اینکه روسای قوا، وزرای ارشد در ایران و قطعاً سفیر آن در سازمان ملل متحد ، از وقوع چنین جنایتی و این همه قساوت و اعدام هایی که در سر تا سر ایران بوقوع پیوسته بود بی‌خبر باشند، غیرممکن است

با کمال تاسف باید خاطر نشان کرد که سوابق تاریخی نشان می دهد نه تنها آقای محمد جعفر محلاتی از موقعیت منحصر به فرد خود در سازمان ملل برای جلب توجه افکار عمومی به این جنایات و همچنین درخواست از دولت ایران برای پایان دادن به این فعالیت های جنایتکارانه استفاده نکرده و به این قتل عام های وحشیانه اعتراضی نکرده است، بلکه متأسفانه آقای محلاتی طی صدور بیانیه ها و سخنرانی هایی منکر این جنایات علیه بشریت شده و میزان اعدام ها و گزارش هایی که با نام اعدام شدگان همراه بوده را غیر واقعی خوانده است.

در این زمینه سازمان عفو بین الملل گزارش می دهد که:

بعنوان مثال، در ۸ آذر ماه سال ۱۳۶۷، طی دیداری با نماینده ویژه سازمان ملل در مورد نقض حقوق بشر در ایران، محمد جعفر محلاتی نماینده دائمی جمهوری اسلامی در سازمان ملل بطور کلی منکر وقوع قتل عام زندانیان سیاسی شده و ادعا کرد که بسیاری از کشته شدگان از اعضای مبارز گروه مجاهدین بوده اند که در پی حمله نظامی این گروه به خاک ایران کشته شده اند.

این ادعای محمد جعفر محلاتی کاملا بی اساس بوده و نادرستی آن بارها و بارها به اثبات رسیده است. بنا بر تمامی مدارک موجود زنان و مردان اعدام شده در تابستان ۱۳۶۷ زندانیان سیاسی ای بودند که بخاطر مبارزات مسالمت آمیز شان سالها بود که در زندان بسر می بردند و دوران محکومیت شان را طی می کردند. همانگونه که قبلا هم گفته شد، حتی برخی از آنان دوران محکومیت شان مدت ها بود که به اتمام رسیده بود. بسیاری از اعدام شدگان متعلق به سازمانهای سیاسی چپ بودند که هرگز در شورشی مسلحانه علیه دولت ایران شرکت نکرده بودند.

بر طبق مدارک ثبت شده در سازمان ملل، آقای محلاتی مدام دست به دروغگویی زده و ادعا می کرده که گفته های گروه های مخالف رژیم کاملا بی اساس بوده وسعی میکرده اطلاعاتی که توسط سازمان های سیاسی در مورد قتل عام زندانیان به نماینده مخصوص سازمان ملل در ایران ارائه داده اند را بی اعتبار کرده و ادعا میکرده که تمامی آنها تنها تبلیغاتی است سیاسی علیه جمهوری اسلامی ایران.

و در زمانی که سازمان ملل با صدور قطعنامه ای نگرانی شدید خود را در مورد اعدام های دسته جمعی در ایران ابراز داشت آقای محمد جعفر محلاتی صدور این قطعنامه را "نا عادلانه" خواند و ادعا کرد که این قطعنامه تنها بر اساس اطلاعاتی جعلی است که یک سازمان تروریستی مستقر در عراق در اختیار سازمان ملل قرار داده است.

طبق اطلاعات موجود، آقای جفری رابرتسون، یکی از وکلای برجسته در زمینه حقوق بشر، اظهار میدارد که:

متخصصین در مسئله جنایات علیه بشریت استدلال می کنند با توجه به در نظر گرفتن همدستی متخصصان و همه اعضا یک رژیم در جنایات علیه بشریت، دلیلی برای مستثنا کردن دیپلمات هایی  که با کتمان حقیقت، نهادهای گوناگون سازمان ملل متحد را از انجام وظیفه بازداشتند؛ وجود ندارد. بازگویی حقایق در پاسخ به پرسش‌های نهاد‌های سازمان ملل از وظایف نمایندگان دولت‌های عضو این سازمان است. جعفر محلاتی، سفیر جمهوری اسلامی در سازمان ملل متحد بارها کشتار زندانیان را انکار کرد و مدعی شد که چنین اتهاماتی در جنگ تبلیغاتی دشمنان رژیم ساخته و پرداخته شده است. گفته میشود که آقای محلاتی ساکن آمریکا است، یعنی جایی که ایشان به خاطر کمک به شکنجه و همچنین حمایت از شکنجه بنا بر قوانین مدنی میتواند محاکمه و مجازات شود.

 با تاکید به حقایق فوق، برای امضا کنندگان این نامه بسیار عجیب و شوکه آور بود وقتی که متوجه شدیم کالج ابرلین آقای محلاتی را به استخدام خود درآورده در حالی که این استخدام با بیانیه وظایف این کالج مبنی بر "تعهد دائم برای یک جامعه پایدار و عادلانه" همخوانی ندارد. ما امضا کنندگان این نامه عمیقا معتقدیم که منابع پیوند داده شده در بالا نقش آقای محلاتی در لاپوشانی جنایات جمهوری اسلامی و دروغ های آشکار او به جامعه بین المللی کاملا آشکار کرده است و حضور او در ابرلین با ارزش های کالج ابرلین در تضاد است. بعلاوه، ما معتقدیم که حضور این شخص در ابرلین لکه ننگی است بر اعتبار کالج شما و ارزش های حقوق بشر.

بنابراین با توجه به دلایل فوق ما از شما تقاضا داریم که:

الف: بررسی ای همه جانبه در خصوص پروسه استخدامی و همچنین اهدا شغل دائمی به آقای محلاتی در کالج ابرلین صورت بگیرد و رسیدگی شود که آیا به نقش این شخص در دوران ماموریت اش به عنوان سفیر دائمی جمهوری اسلامی ایران در سازمان ملل، بهایی داده شده؟ آیا مشاوره ای با سازمان های حقوق بشری در مورد عملکرد این شخص در زمان ماموریت اش و نقش او در نقض مداوم حقوق بشر در ایران، صورت گرفته و یا کلا تمامی عملکرد های او نادیده گرفته شده بود.

ب: برکناری آقای محلاتی از شغلش در کالج ابرلین

پ: کالج ابرلین طی نامه ای بخاطر استخدام و ارتقا مقام آقای محلاتی، شخصی که در مخفی کردن جنایات مرتکب شده علیه بشریت توسط جمهوری اسلامی نقش بسزائی داشته، از تمامی قربانیان قتل عام تابستان ۱۳۶۷ و خانواده هایشان عذرخواهی کند

ما از شما محترمانه تقاضا میکنیم که به موضوع مندرج در این نامه در اسرع وقت رسیدگی کرده و نتایج رسیدگی تان را به آقای کاوه شهروز و خانم لادن بازرگان ارسال دارید
